Purpose and scope

Within GoSea Digital Ltd (“We”,”Us”,”Our”,“Workrest”) We understand how important privacy, information security and data protection are to Our users. We aim to be as transparent as possible in how We will use personal data and this privacy notice (“this notice”) is intended to provide information to that effect. This notice applies to both workrest.co (“the website”) and the Workrest Application (“the App”), collectively referred to as the Platform, which are both provided by GoSea Digital Ltd.

It is important that you read this notice carefully as it contains information about what personal data will be collected, how it will be used, how long it will be retained for, where it will be stored, and who it will be shared with. It also provides you with information about how you can contact Us, and/or exercise your rights should the need arise.

GoSea Digital Ltd are registered with the Office of the Information Commissioner within the United Kingdom under registration number:[00015227862]. We are the Data Controller, this means that we determine factors such as what information is needed to be collected, and how it should be used, who it can be shared with etc.

As an organisation that is situated within the United Kingdom we are subject to a range of laws regarding the use of personal data including the Data Protection Act 2018, where we offer services outside of the UK we also endeavour to comply with the obligations imposed upon controllers in those territories, such as the General Data Protection Regulation 2016 when operating in the European Economic Area.

Personal data collected by workrest

The following types of personal data may be processed during your use of the Platform. The actual personal data We process will however be dependent on how you use the platform:

  • Name (First & Surname) – so that We can identify you and also to enable the vessel that you are working on to identify you.
  • Email – to be used to access your account, and to enable Us to communicate with you (example; to send your completed monthly timesheet if using workrest : HoR, notify you a t-shirt giveaway competition we’re running)
  • Telephone number – this enables Us to verify that it is you accessing your account
  • Password – to enable you to access your account, however your password is never visible to Us
  • Vessel(s) – so that We can ensure that information you submit via the Platform is accurately recorded
  • Billing information – should you become a paid User, information will be captured to obtain and process payment
  • Work information – such as your job role, hours and pattern of working, as well as hours of rest
  • Online identifiers – when you access the Platform we may receive information such as MAC address, IP Address and other identifiers for you or your device, for further information about this please refer to Cookie Notice.

In certain instances the personal data is required, such as an email address or password, without providing this information you will not be able to make use of the Platform.

We collect personal data from you:

  • directly, such as when you access the Platform to register or enter your work information, and
  • indirectly, such as your browsing activity while on the Platform, which is generated and received by your device or web browser

How and why we use personal data

Data protection laws within the UK and EEA (the Data Protection Laws) require that We have a purpose for processing your personal data, further information about the purposes for which We process your personal data for are set out below:

The Data Protection Laws also require that where special, or sensitive, categories of personal data are to be processed additional safeguards are adopted, We currently do not process any of this type of personal data.

Marketing
From time to time We may use your personal data (Name and email) to send you updates about the Platform, including enhancements, new feature or functions. Where We do so We will rely on either consent or legitimate interest. We may also use certain limited categories of your personal data to prevent you being identified or targeted during any marketing campaigns that We may conduct.

Sharing personal data

Only under essential circumstances do we share personal data with:

  • third-party suppliers who provide services to Us which enable the Platform to continue to operate e.g. hosting providers, technical experts etc.
  • third-party We use to help promote the platform and raise awareness, such as marketing agencies, communication providers etc.
  • other crew members, or staff or management companies who have a need to know.

In certain circumstances where sharing is required your personal data may be provided to Our professional advisers, as well as to law enforcement, judicial and regulatory agencies.

Whether routinely or otherwise, We only work with, and share your personal data with, third parties who share Our commitment to privacy and data protection. Even then We restrict third-party access to the least amount of personal data necessary in order for them to perform the service.

We do not sell your personal data and have no intention of this ever changing.

Retention of personal data

We will not keep your personal data for longer than We need it for the purpose for which it is used. We will typically retain personal data for up to seven years from when you cease to use your account, after that time your personal data will either be deleted or anonymised.

Transfers of personal data

The Data Protection Laws contain certain requirements that We must adhere to when transferring personal data outside of the UK and EEA. It is sometimes necessary for Us  to share your personal data to countries outside the UK and EEA. In those cases We will comply with the Data Protection Laws designed to ensure the privacy of your personal data and will utilise appropriate measures to ensure that your personal data is still handled in accordance with the standards afforded by the Data Protection Laws.

If you are situated in the UK or EAA you generally have the following rights, which you can usually exercise, although certain rights are restricted in certain scenarios. If you are situated outside of the UK or EEA then you may have different rights and entitlements, you may exercise these rights by using the contact details provided in the How to contact us

Access
You may request a copy of your personal data.
Correction / Rectification
If you believe that there is an error within your personal data you may request that We correct this.
Erasure (also known as the right to be forgotten)
In certain circumstances you may ask that We delete your personal data.
Restriction of / objection to use
You may ask that We don’t use your personal information for certain things, e.g. not to receive marketing content.
Data portability
In certain circumstances you may request that We transfer your personal data to a third-party.

How to complain

We would always ask that you contact Us  directly should you have any concerns, complaints, or queries regarding privacy or data protection, doing so will provide Us  with the opportunity to investigate and engage with you. You do however have the right to lodge a complaint with the ICO, or to the relevant regulatory body in the territory that you live or work in.
